Right to Strike– A Legal study of workers’ fundamental Rights and Industrial Peace

Labor law creates a fundamental conflict through the protection of workers' right to strike which must balance between their right to collective action and the need for industrial tranquility and economic stability. This research studies how international human rights standards constitutional rights and statutory laws establish the legal framework for the right to strike in different countries. The research investigates different legal systems' treatment of workers' rights to join together as groups while balancing their rights against employer needs and public interests through a study of legal principles from India and the United States and the United Kingdom and international labor standards. The research analyzes how strike law evolved through judicial decisions which established rules for legal and illegal strikes and created methods to protect industrial relations. The study findings demonstrate that people consider the right to strike as an essential part of freedom to associate yet authorities impose many rules which restrict its use, so it remains unknown whether existing laws effectively protect workers' bargaining rights under current economic conditions.
